Omaya Care is a postpartum maternal health platform that delivers scheduled check-ins to mothers after birth, via voice call and WhatsApp, on behalf of hospitals and clinics in Ghana. We are committed to protecting your personal and health information. This policy explains what data we collect, why we collect it, how we use it, who we share it with, and what your rights are.
This policy applies to all mothers enrolled in Omaya Care through a hospital or clinic partner, as well as anyone who visits our website or interacts with our service.
We process personal data in accordance with Ghana's Data Protection Act 2012 (Act 843).
Omaya Care is currently in the process of formal registration in Ghana. For any questions or concerns, contact us directly at admin@omayacare.com. When we refer to "Omaya Care," "we," "us," or "our" in this policy, we mean this entity.
We collect the following categories of information:
Personal identification data
Your full name, phone number, age, and preferred language.
Clinical and health data
Your delivery date, hospital or clinic of delivery, responses to postnatal check-in questions, any symptoms or concerns you report during a check-in, and any escalation flags raised during your care.
Communication data
Records of voice calls and WhatsApp messages exchanged through the Omaya Care service.
Device and usage data
If you visit our website, we may collect basic information such as your browser type, device type, and pages visited. We do not use this to identify you personally.
Data collected by your hospital
When a hospital or clinic enrolls you in Omaya Care, they share basic information with us including your name, phone number, delivery date, and preferred language. This is done with your knowledge and consent at the point of enrollment.

We use your data only for the following purposes:
To deliver postnatal check-ins
We use your phone number, preferred language, and delivery date to contact you at the right times on the WHO-recommended postnatal schedule: within 24 hours of birth, day 3, days 7 to 14, and week 6.
To support your clinical care team
Your check-in responses are reviewed by or flagged to the midwife or clinical team at the hospital that enrolled you. They use this information to follow up with you if a concern is identified.
To improve our service
We may use anonymised and aggregated data, with no personally identifying information, to improve the quality of our check-in content and escalation protocols.
To communicate with you
We may send you service-related messages such as reminders about upcoming check-ins or updates to the service.
We do not use your data for advertising. We do not sell your data. We do not use your data for any purpose not listed here without your explicit consent.
Under Ghana's Data Protection Act 2012, we process your data on the following grounds:
For health data specifically, which is a sensitive category under the Act, we rely on your explicit consent and the necessity of processing for healthcare purposes.
Your hospital or clinic
The midwife and clinical team at the facility that enrolled you will see your check-in responses and any escalation alerts generated during your care. They are your primary care providers and are bound by their own professional and legal obligations to protect your information.
Escalation partners
If a concern is flagged during a check-in that requires routing to a specialist, for example a psychologist, paediatrician, or nutritionist, we may share relevant information with that partner to facilitate your care. This will only happen with your prior knowledge.
Technology service providers
We work with third-party technology providers to operate our platform, including cloud hosting, SMS and WhatsApp messaging infrastructure, and data storage. These providers process data only on our instructions and are contractually bound to protect it.
Legal and regulatory authorities
We may disclose your data if required to do so by law, regulation, or court order.
We do not share your data with any other third parties.
We retain your personal and health data for as long as necessary to deliver your postnatal care, and for a defined period after the end of your care, in line with applicable health record retention standards in Ghana. After this period, your data is securely deleted or anonymised.
You may request deletion of your data at any time. See Section 10 for how to do this.
We take the security of your data seriously. We use the following measures to protect it:
No system is completely secure. If a data breach occurs that affects your rights and freedoms, we will notify you and the relevant authorities as required by law.

Right to access
You can request a copy of the personal data we hold about you.
Right to correction
You can ask us to correct any inaccurate or incomplete data we hold about you.
Right to deletion
You can ask us to delete your data. Note that in some cases we may be required by law to retain certain records.
Right to withdraw consent
You can withdraw your consent to us processing your data at any time. This will not affect the lawfulness of processing carried out before your withdrawal.
Right to complain
If you believe we have handled your data unlawfully, you have the right to lodge a complaint with the Data Protection Commission of Ghana.

Omaya Care is a service for mothers aged 18 and above. We do not knowingly collect data from anyone under 18. If you believe a minor's data has been collected in error, contact us immediately at admin@omayacare.com.
We may update this policy from time to time. If we make significant changes, we will notify you through the channel we normally use to reach you, either by WhatsApp or voice. The date at the top of this policy will always reflect when it was last updated.
